The Monroe County Sheriff’s Office arrested a Fort Myers, Florida woman on Sunday after she left her daughter alone at a bar and then kicked and spat on several deputies.
Deputies responded to a report of a child separated from her mother at the Marriott Courtyard in Marathon around 10:18 p.m., where they found 28-year-old Kimberly Nicole Day standing with her 7-year-old daughter.
According to the report, hotel security told deputies they found the daughter alone at the bar. Deputies spoke with Day’s boyfriend, who stated he and Day had been fighting all day, leading him to check out of the hotel so he could go back to Fort Myers.
Deputies attempted to speak to Day, who appeared “severely intoxicated,” according to the report. While trying to speak to her, Day was holding her daughter tightly against her. As deputies talked to her, she continued to tighten her grip on her daughter. At some point she moved her arms higher, while continuing to grip harder, leading to her choking her daughter. A deputy reported that this was an inadvertent action caused by her severe level of intoxication.
Deputies ordered Day to release her daughter, but she refused. Deputies reported that the child opened her mouth as if to gasp for air, but was unable to catch a breath. Deputies then grabbed Day in an attempt to release the child from her grip. They were able to free the daughter, who began to cry. Meanwhile, Day began to scream and resist the deputies.
Once the child was taken from her, Day began to shout expletives and repeatedly kick the deputies restraining her. Then, while attempting to handcuff her, Day began to try and defecate in her hand, saying she would throw the feces at the deputies.
Deputies were able to restrain Day with handcuffs and a hobble to prevent her from any further kicking.
Deputies transported Day to Fisherman’s Community Hospital for medical evaluation, where she continued to spit at nurses and deputies. When asked why she kept doing this, a deputy reported that she said something to the effect of “I get satisfaction out of it.” She was ultimately sedated by hospital staff.
Day was charged with three counts of battery on an officer/EMT, one count of child neglect and one count of resisting an office with violence. She was transported to the Monroe County Sheriff’s Office where she was being held without bond.
