A report of a vehicle swerving in its lane led to the arrest of a Miami man for DUI and drug possession on Sunday.
Lazaro Jose Hoyos, 46, was charged with DUI, possession of marijuana under 20 grams and possession of paraphernalia.
Around 12:35 a.m., a caller reported a reckless driver going southbound on U.S. 1 near Mile Maker 70, stating that the driver was having trouble maintaining their lane. A Monroe County Sheriff’s Office deputy responded and located the reported vehicle, a gray Jeep, parked on the side of the road.
The deputy found the driver, identified as Hoyos, sitting in the car with the keys in the ignition. Upon meeting with him, the deputy immediately reported smelling the odor of marijuana. According to the report, the deputy asked Hoyos to step out of the vehicle and noticed that he had slurred speech and was struggling to maintain balance. The deputy had Hoyos perform a field sobriety test, which he ultimately failed, despite stating he hadn’t had anything to drink that night.
A Florida Highway Patrol trooper arrived as backup, and the car was searched prior to Hoyos’ arrest. Inside, they found approximately one gram of marijuana and a pipe. Hoyos was arrested and transported to the Marathon DUI room, where his breath samples showed that he had in fact not had anything to drink. He then consented to a blood draw for drug testing, although the results for the test were still pending at the time of the report.
Hoyos was transported to the Monroe County Detention Center, but was released later the next day after posting a $5,000 bond.
